NEW LAW CHANGES THAT COULD IMPACT YOU
Prior to November, 2025, a first offense DUI was a misdemeanor. THAT IS NOT ALWAYS THE CASE NOW! If your breathalyzer result is over 0.15, if you have an accident (even if the damage is only to your car), are speeding 20 mph over the speed limit (10 mph if in a school zone), are driving recklessly or have someone under the age of 18 in your vehicle you will be charged with a FELONY, even if it’s a first offense! This felony carries a minimum of 10 days in jail even if you get a deferred (no conviction) sentence and could face prison time. Drug possession charges are also now potentially enhanceable from misdemeanors to felonies. And, the punishment ranges have increased. Because of the rise in fentanyl use and deaths, any measureable amount of fentanyl could be charged as drug trafficking…a very serious felony charge! AND MORE CHANGES ARE UNDERWAY WITH NEW LEGISLATION EFFECTIVE LATER IN 2026!
